The President of the ALDE party is adamant that some member states use the imposition of sanctions by the United States as a pretext for illegal repression against individuals and companies
Yesterday in the plenary hall, the MRF MEP and Pesident of the ALDE party Ilhan Kyuchyuk stated his position on the European law “Magnitsky”, which is analogue to the American global regime of sanctions for human rights violations. The MEP expressed concern about the negative impact of the US act on Member States which use the imposition of sanctions by the United States as a pretext for unlawful reprisals against individuals and companies. According to him, the existing negative practice of misinterpretation of the American law “Magnitsky” by Member States should not be allowed regarding its European analogue.
„The European “Magnitsky” should not become an instrument of over-repression and human rights violations. For example, on June 2, 2021, the United States imposed sanctions under the Global Magnitsky Act on Bulgarian citizens, as well as on a number of related companies. Although the Caretaker Bulgarian government is aware of European regulation and the inapplicability of sanctions on the territory of Bulgaria, this government has created the so-called “black list” of persons and companies associated with it with sanctioned citizens.This created a precondition for absolute administrative arbitrariness on the one hand and, on the other hand, infringed the rights of the sanctioned and related companies to such an extent that it made it practically impossible for them to have any contact with the state authorities in their own country. “Something that sanctions under the US Magnitsky Act neither envisage, nor aim at, nor allow for extension to an unlimited number of people accused of being ‘connected’ to the sanctioned, at the subjective discretion of national governments,” said the President of the European Liberals.
According to him, the sanctions under the “Magnitsky” law should not become a tolerated excessive punishment, without the guilt being proved by an independent judicial body, when assessing all the facts and evidence.
